Big Spice Terms of Use

Last updated: September 21, 2026

Effective: September 23, 2026

The short version

This summary is here for your convenience. It is not the contract. If the summary and the full text below say different things, the full text governs.

  • Big Spice helps you cook. You are the cook. You are responsible for your kitchen, your food and the people you feed.
  • Recipes, quantities, times, temperatures, allergen and diet information in the App can be wrong. This applies most of all to anything imported from a link, a video or a photo, and to anything produced by Ask the Chef. Always check before you cook and before you eat.
  • Big Spice is not medical, nutritional, dietary or food-safety advice.
  • Timers, alarms, notifications and voice guidance are aids. They can fail. Never leave cooking unattended because of them.
  • Pro is an auto-renewing subscription billed by your app store. AI Features, such as importing a recipe and Ask the Chef, are part of Pro. Cancel in your store account settings at least 24 hours before the renewal date. Deleting the App or your data does not cancel it. Refunds are handled by the store.
  • Pro is not unlimited, and nothing in Big Spice is sold as unlimited. Fair usage limits apply to Pro features. A request counts toward them as soon as our servers accept it, even if it fails. We do not publish the numbers.
  • The App is provided “as is”. Our liability is limited as far as the law allows. Consumers in Europe and Turkey have their own liability rules in section 17.6. Nothing in these Terms takes away rights that the law says cannot be taken away.

1. About these Terms

1.1 Who we are. The App is published by Ryon Labs LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA. In these Terms, “Big Spice”, “we”, “us” and “our” mean that company.

1.2 What these Terms are. These Terms of Use (the “Terms”) are a legally binding agreement between you and us. They cover your use of the App.

1.3 Words we use.

  • “the App” means the Big Spice mobile application, everything in it, and the online services that support it.
  • “Pro” means the paid subscription tier of the App.
  • “Usage allowance” means the amount of a Pro feature that you can use before a fair usage limit stops it (section 6). The App may show a usage allowance as “credits”.
  • “AI Features” means any feature of the App that uses automated systems, including artificial intelligence, to produce, read, convert or change content. Today this includes importing a recipe from a web link, a video link or a photo; Ask the Chef; recognizing ingredients from a photo; and any other feature that we describe as automated or AI-assisted.
  • “Output” means anything produced by an AI Feature, including recipes, recipe ideas, ingredient lists, steps, timers, translations and conversions.
  • “Imported Content” means content that you bring into the App from a source outside it, such as a web page, a video, a photo or pasted text, and the recipe that the App produces from that source.
  • “Your Content” means anything you submit to or create in the App, including links, photos, text, questions, ingredient lists, preferences, notes and recipes you save or edit. It includes Imported Content to the extent that you hold rights in it.
  • “Store” means the app store you got the App from, such as Apple’s App Store or, when the App is available there, Google Play.

1.4 Accepting these Terms. By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1.5 Privacy. Our Privacy Policy explains how we handle personal data. Please read it. It is a notice, not part of this contract.

2. Who may use the App

2.1 Not for children under 13. The App is for a general audience. It is not directed at children. You must not use the App if you are under 13.

2.2 Teenagers. If you are 13 or older, but under the age at which you can agree to a contract or consent to the use of your data where you live, you may use the App only if a parent or guardian has read and accepted these Terms for you and supervises your use. Depending on your country, that age can be anywhere between 13 and 18. A parent or guardian who allows a minor to use the App is responsible for that use, including any purchases.

2.3 Cooking is an adult task. Cooking involves heat, sharp tools and other hazards. Minors should cook only under adult supervision.

2.4 Personal use. The App is for your personal, non-commercial use only.

2.5 Legal ability. You may use the App only if the law that applies to you allows it. See also section 22.

3. Your license to use the App

3.1 What you get. As long as you follow these Terms, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the App on devices that you own or control, for your personal, non-commercial use, as allowed by the rules of your Store.

3.2 Licensed, not sold. The App is licensed to you. It is not sold to you. We and our licensors keep all rights that these Terms do not expressly give you.

3.3 Updates. We may release updates. Some features may stop working until you install them. We may stop supporting older versions of the App, older devices and older operating systems.

4. Your account and the data on your device

4.1 No sign-up. You do not need to register to use the App. When you first open the App, it creates a random account identifier for you. It does not contain your name, your email address or a password.

4.2 Your data lives on your device. Your recipe library, the recipes you save or import, your cooking history, your shopping list and your preferences are stored on your device. We do not keep a backup copy of them. If you delete the App, or lose, reset, replace or damage your device, this data may be lost for good and we cannot restore it. You are responsible for your device and for any backups you choose to make with your device’s own tools.

4.3 Sign-in may come later. We may offer optional sign-in, for example with an Apple or Google account. If you use it, you must keep your sign-in details safe and you are responsible for what happens under your account. A sign-in or backup feature protects only the data that the feature says it covers.

4.4 Purchases follow your Store account. Your Pro subscription belongs to the Store account that bought it, not to a Big Spice profile. See section 5.8 for how to restore it.

4.5 Other people on your device. You are responsible for anyone who uses the App on your device.

4.6 Deleting your data. Settings has a “Delete my data” button. It erases the data the App stores on your device, and it asks our servers to erase the personal records held against your account identifier. The App then starts again as a new install, with a new account identifier. It cannot be undone. We cannot restore anything it erased. It also removes any cooking timers that are waiting to alert you, so do not use it while you cook. It does not cancel a Pro subscription (section 5.5). Our Privacy Policy explains what it erases and what we keep.

5. Pro subscriptions

5.1 What Pro is. Most of the App is free. Pro is an optional paid subscription. AI Features are part of Pro. Without Pro you cannot use them. If you try, the App offers you Pro instead. Today that means importing a recipe from a web link, a video link or a photo, and Ask the Chef, including adding ingredients from a photo. Pro is not unlimited. Nothing in the App is sold as unlimited, and fair usage limits apply to every Pro feature (section 6). The rest of the App does not need Pro today. That includes the built-in recipe library, cooking, the step drawings and the voice clips that come with the App. The features included in Pro are the ones described in the App at the time you buy. They may change over time (section 14).

5.2 Plans and prices. Pro is sold as a monthly plan or a yearly plan. The name of the plan, its length and its price are shown in the App on the purchase screen before you confirm. Prices can differ by country and by Store, and may include taxes.

5.3 The Store bills you. Payment is charged to your Store account when you confirm the purchase. The Store processes the payment. We never receive or store your card details. The Store’s own terms and payment rules also apply to your purchase.

5.4 Automatic renewal. Your subscription renews automatically for the same period, at the price then in effect, unless you cancel at least 24 hours before the end of the current period. Your Store account is charged for the renewal within 24 hours before the end of the current period.

5.5 How to cancel. You manage and cancel your subscription in your Store account settings. On an iPhone, open Settings, tap your name, then tap Subscriptions. Deleting the App does not cancel your subscription. Neither does “Delete my data” in Settings. When you cancel, the next renewal stops, and you keep Pro until the end of the period you have already paid for. We cannot cancel a Store subscription for you.

5.6 Refunds. Purchases are processed by the Store, so refund requests are handled by the Store under its own policy. Except where the law requires otherwise, we do not give refunds or other compensation for a period that has partly run, for features you did not use, or for usage allowances you did not use.

5.7 Your legal rights as a consumer. If you live in the European Economic Area, the United Kingdom, Turkey or another place where the law gives consumers a right to withdraw from a digital purchase, or remedies when a digital service does not conform to the contract, these Terms do not limit those rights.

Your Store takes your order and your payment. So you ask the Store, not us, to withdraw from a purchase or to refund it, using the procedure the Store gives you. Where the law gives you a right to withdraw from a digital purchase, the period is usually 14 days from the day you bought. If you asked for Pro to start straight away, your local law may say that the right is limited or lost once Pro has started, or that you must pay for the part you have already received. The Store’s purchase flow and its terms deal with that request. None of this affects your rights when a digital service does not conform to the contract. Those rights last for the period your local law sets. If the Store does not help you, write to us at info@ryonlabs.com.

5.8 Restoring a purchase. If you reinstall the App, move to a new device or use “Delete my data”, use “Restore purchases” in the App while you are signed in to the same Store account that bought Pro. Restoring a purchase does not give you a new usage allowance (section 6.6).

5.9 Price changes. We may change the price of Pro. For an existing subscription, a new price applies only from a later renewal, after the notice that the Store and the law require. The Store may ask you to accept the new price. If your acceptance is required and you do not give it, your subscription ends at the end of the current period.

5.10 Trials and offers. We do not offer a free trial today. If we offer a trial or a promotion in the future, the terms shown with that offer apply. Where the Store’s rules say so, any unused part of a free trial is lost when you buy a subscription.

5.11 When Pro ends. When your subscription ends, you lose access to Pro features. The free features of the App stay available. Recipes that are already saved in your library stay on your device, but anything that needs a Pro feature will no longer work. Usage allowances that you did not use expire. They have no cash value.

6. Fair usage limits

6.1 Why limits exist. Each use of a Pro feature costs us money. To keep the service sustainable and to prevent abuse, fair usage limits apply to Pro features. Pro does not mean unlimited use. The App may show your usage allowance as credits. A credit is a unit for counting use. It is not money.

6.2 How limits work. Limits may apply per minute, per day, per month or per billing period. They may apply per account, per device or per network. They may also apply to a single request, for example the length of a video, the size of a photo or the size of a web page. We do not publish the numbers. They may differ between plans, regions and users, and we may change them at any time.

6.3 At the limit. When you reach a limit, the feature stops working until the limit resets, and the App will normally tell you. Today, a monthly allowance runs by calendar month. It starts again on the first day of the next month. That may not be the day your subscription renews. Reaching a limit is not a fault in the service. Except where the law requires otherwise, it does not entitle you to a refund, an extra usage allowance or an extension.

6.4 Attempts count. A request counts toward your limits as soon as our servers accept it. It counts whether or not you get a result you can use. It counts even if the request fails, even if the result is wrong or unusable, and even if the failure is on our side or on the side of a website, a video platform or a service provider. Examples: a link that has no recipe in it, or that our servers cannot open; a video that is too long, private or removed; a photo that does not show a recipe, or that cannot be read; a question that gets no usable answer; a result that comes back damaged; a recipe that could not be saved. This is because a request costs us money as soon as work on it starts, whatever the outcome. The App may not tell you each time a request is counted. Except where the law requires otherwise, we do not give a counted request back. A request does not use any of your usage allowance if it is stopped before our servers accept it, for example because you are offline, because you have reached a rate limit, because you have no allowance left, or because a file is too large or of the wrong type. It may still count toward a rate limit.

6.5 No workarounds. You must not try to get around limits, for example by using several accounts, resetting the App, sharing access or sending automated requests. If we reasonably believe you are doing this, we may limit, suspend or end your access (section 19).

6.6 Allowances are personal. Usage allowances, including any that the App shows as credits, are personal to you. They have no cash value. They cannot be transferred, sold or exchanged. They do not carry over from one period to the next. Deleting your data, reinstalling the App or restoring a purchase does not give you a new allowance.

7. AI Features and their risks

Please read this section carefully. It explains what AI Features cannot do and what you are responsible for.

7.1 Automated, not human. AI Features are run by automated systems, including artificial intelligence. No chef, dietitian, doctor or other person reviews Output before you see it. Ask the Chef and the chef characters in the App are not real people.

7.2 Output can be wrong. Output may be inaccurate, incomplete, out of date, unsafe or unsuitable for you. It may sound confident and still be wrong. This applies to every part of a recipe, including:

  • ingredients, quantities, units and unit conversions;
  • servings and scaling;
  • cooking times, temperatures and signs of doneness;
  • the order of steps, and the timers the App sets from them;
  • allergen information;
  • whether a dish fits a diet, or a religious or ethical rule (for example vegetarian, vegan, gluten-free, halal or kosher);
  • nutrition and calorie information;
  • substitutions;
  • storage, cooling, reheating and other food-safety guidance;
  • the equipment you need; and
  • whether an imported recipe matches its source.

Output may leave out a warning that the source contained. It may include an ingredient that you asked the App to avoid.

7.3 You must check. Treat Output as a suggestion and a starting point, never as a fact. Before you cook or eat, read the whole recipe, compare it with the original source if there is one, read the labels on your ingredients and use your own judgment. If something looks wrong, do not follow it.

7.4 Preferences and filters are not guarantees. Your diet settings, dislikes and avoid lists help to guide suggestions. They are not a safety system. They do not guarantee that a recipe is free of any ingredient or allergen.

7.5 Photos of ingredients. When the App reads ingredients from a photo, it may name an item wrongly or miss it. It cannot tell whether food is fresh, safe to eat or within its date.

7.6 Not professional advice. Output is not medical, nutritional, dietary, food-safety or other professional advice. See section 8.

7.7 Output may not be unique. Other people may receive the same or similar Output. We do not promise that Output is free of other people’s rights. As between you and us, we do not claim to own Output that was produced for you. You may use it for your personal, non-commercial use, subject to these Terms and to any rights that others hold in the source material.

7.8 What you submit. To produce Output, the App sends what you submit to our servers and to AI service providers that work for us. Before the App sends anything to an AI Feature for the first time, it asks your permission. Nothing is sent until you allow it. You can withdraw the permission in Settings. AI Features do not work without it. Do not submit personal, confidential or sensitive information. AI Features do not need it. See our Privacy Policy.

7.9 Other automated content. Some content in the App, such as translated text, character voices and images, may have been created or assisted by automated tools, including artificial intelligence. The same cautions apply to it.

7.10 Refused requests. AI Features are for cooking. We may filter, refuse or limit requests, and block Output, for example where a request is not about cooking or may be unsafe or unlawful.

7.11 Your risk. To the maximum extent permitted by applicable law, you use AI Features and rely on Output at your own risk. Sections 16 and 17 apply.

8. Food safety, allergens and health

You are the cook. What happens in your kitchen is your responsibility.

8.1 Cooking has risks. Cooking involves heat, flame, hot oil, steam, sharp tools, electrical and gas appliances, and raw or undercooked food. The App cannot see your kitchen. It does not know your equipment, your skills, your ingredients or your health. You alone decide whether and how to follow a recipe, a step, a timer or a suggestion. You alone are responsible for the results. Those results can include burns, cuts, fire, smoke, damage to property or equipment, food poisoning, allergic reactions and other illness or injury, to you or to anyone you cook for.

8.2 All recipes are general information. This applies to every recipe in the App, including the built-in library. Times and temperatures are estimates. Ovens, stovetops, pans and ingredients vary. Check for yourself that food is cooked through and safe to eat. Use a food thermometer, and follow the official food-safety guidance for your country. Take extra care with meat, poultry, fish, shellfish, eggs, rice and reheated food. Take extra care when you cook for anyone who is pregnant, for young children, for older people or for anyone with a weakened immune system.

8.3 Allergens. We do not guarantee that any recipe, ingredient list, substitution, label or filter in the App is free of any allergen, or safe for any allergy, intolerance or medical condition. Allergen and diet labels in the App may be incomplete or wrong. Ingredients differ between brands and countries, and cross-contamination can happen in any kitchen. Always read product labels. If you or someone you cook for has an allergy or an intolerance, do not rely on the App.

8.4 Diets and beliefs. We do not guarantee that a recipe meets the rules of any diet, religion or ethical practice. Check every ingredient yourself.

8.5 Not medical or nutritional advice. The App does not give medical, nutritional or dietary advice. Nutrition figures, calorie counts, labels such as “light”, and estimates of time or money saved are rough estimates for general interest. Talk to a qualified professional before you change your diet, especially if you have a medical condition, if you are pregnant, or if you cook for someone who is.

8.6 Stay in the kitchen. Never leave cooking unattended. Keep children and pets away from hazards. Follow the instructions of the maker of your appliance. They take priority over anything in the App.

8.7 Your device in the kitchen. Be careful when you use your device near heat, water, steam and grease. We are not responsible for damage to your device.

8.8 Emergencies. The App is not a safety or emergency service. In an emergency, call your local emergency number.

9. Imported Content and third-party content

9.1 Import is a tool that you direct. When you import, you ask us to fetch and process a source for you, so that you can keep a personal copy in a form the App can use. You choose what to import. We do not choose or review it.

9.2 It belongs to its owners. Imported Content belongs to its owners. We do not claim to own it and we do not endorse it. Importing something does not give you any rights in it that you did not already have.

9.3 Personal use only. You may use Imported Content only for your own personal, non-commercial cooking. You must not publish it, sell it, share it widely or use it commercially.

9.4 Your promise to us. Each time you import, you confirm that:

  • you have the right to access the source and to make a personal copy of it for this purpose;
  • doing so does not break the law, any other person’s rights, or any contract or website terms that bind you;
  • you are not getting around a paywall, a login or any technical protection; and
  • the content is not unlawful.

9.5 Accuracy. An imported recipe is an automated reading of its source. Section 7 applies to it. It may differ from the source, and it may leave out warnings, notes and credits. The original source is the reference. Check it.

9.6 Sources can fail. Websites and video platforms may block access, change or remove content at any time. Import does not work with every source. We do not control third-party websites or platforms. Unless we say so, we are not connected with them, and we are not responsible for their content or availability.

9.7 Blocking. We may block a source, refuse an import, and stop new imports from a source, where we reasonably believe that it infringes someone’s rights or is unlawful, or where a rights holder asks us to. A copy that is already on your device is outside our reach. If we tell you that a copy infringes someone’s rights, you must delete it.

9.8 Notice for rights holders. If you believe that content made available through the App infringes your rights, write to info@ryonlabs.com. Please include: (a) the work or right you say is infringed; (b) the content or source concerned, with its web address if it has one; (c) your name and contact details; (d) a statement that you believe in good faith that the use is not authorized by the rights holder, its agent or the law; (e) a statement that your notice is accurate and that you are the rights holder or are authorized to act for the rights holder; and (f) your physical or electronic signature. We will review the notice and take the action we consider appropriate. We do not monitor what people import, and we have no duty to do so. If we act on a notice, we will tell the person affected where we can. They may reply to us at the same address and explain why the content is lawful. We keep a record of the notices we receive. We may end the access of anyone who infringes repeatedly, or who is the subject of repeated valid notices.

9.9 Links. The App may link to third-party websites, for example the source of an imported recipe. You visit them at your own risk and under their terms.

10. Your Content

10.1 You keep your rights. You keep whatever rights you hold in Your Content.

10.2 The license you give us. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, adapt and display Your Content, and to let our service providers do the same on our behalf. Adapting includes changing its format, translating it and converting units. We may use this license only to operate, provide, maintain, secure and support the App for you, and to comply with the law. The license lasts for as long as we need it for those purposes. This license is a permission. It does not describe what we do with Your Content in practice. Our Privacy Policy does that, including how long we keep what you submit to AI Features.

10.3 Your responsibility. You are responsible for Your Content. You confirm that you have the rights you need to submit it, and that it does not break the law or these Terms.

10.4 What not to submit. Do not submit other people’s personal information, sensitive information about yourself, or photos that show people, documents or anything else you would not want to be processed. Photos should show food, ingredients or a recipe.

10.5 Feedback. If you send us ideas or feedback, we may use them freely, without any obligation or payment to you.

11. Acceptable use

You must not do any of the following, or help anyone else to do them:

  • (a) Copying at scale. Scrape, crawl, harvest, bulk-download or systematically extract recipes, drawings, voice clips or any other content from the App.
  • (b) Reverse engineering. Reverse engineer, decompile or disassemble the App, or try to discover its source code, its prompts, its configuration or the systems and providers behind it, except where the law expressly allows this despite this restriction.
  • (c) Circumvention. Get around, disable or interfere with security features, access controls, payment requirements, usage limits or rate limits. This includes using several accounts, resetting identifiers or using a modified version of the App.
  • (d) Automated access. Use bots, scripts, unofficial apps or any other automated means to reach the App or our services, or send requests that the App itself did not make.
  • (e) Resale and commercial use. Resell, rent, lease, sublicense or share access to the App or to Pro. Use the App to provide a service to others, to build a competing product or a dataset, or to train a machine-learning model.
  • (f) Unlawful or harmful content. Submit content that is unlawful, infringing, harmful, abusive, hateful, sexual or deceptive, or that contains malicious code. Try to make AI Features produce such content, produce content that is not about cooking, or ignore their safeguards.
  • (g) Harm to the service. Use the App in a way that could damage, overload or impair it, or interfere with anyone else’s use of it.
  • (h) Fraud. Misrepresent who you are, misuse a Store account or a payment method, or abuse refunds.
  • (i) Notices. Remove, hide or change any copyright, trademark or other notice in the App.
  • (j) Breaking the law. Use the App in a way that breaks any law or anyone’s rights, or in any situation where using it would be dangerous.

We may investigate suspected breaches and act on them, including under section 19.

12. Intellectual property

12.1 What is ours. The App and everything in it belong to us or to our licensors and are protected by intellectual property laws. This includes the software and the design; the built-in recipes as written, selected and arranged; the step drawings and animations; the dish images; the chef characters and their names, personalities, voices and lines; the audio and the text; and the “Big Spice” name, logo and look and feel.

12.2 No other rights. You get no rights in any of this except the license in section 3. You must not copy, publish, distribute, record, adapt or make derivative works from content in the App, except as the law allows for personal use. You must not use our name, logo or characters without our written permission.

12.3 Other people’s marks. Names and trademarks of third parties belong to their owners. Their appearance in the App does not mean that they endorse us, or that we endorse them. Apple and App Store are trademarks of Apple Inc. Google Play is a trademark of Google LLC.

13. Timers, alarms, notifications and voice

13.1 Aids only. Timers, alarms, notifications, voice guidance and similar features are conveniences. They depend on your device, its operating system and its settings, such as silent mode, focus modes, low-power mode, volume, notification permission and connected audio devices. They also depend on your battery and on whether the App is open. They can be late, silent or wrong, or they may not happen at all.

13.2 Never a safety device. These features are not a safety device. They do not replace watching your food, a smoke alarm, or the safety features of your appliances. Never leave cooking unattended because you expect the App to alert you.

13.3 Based on estimates. Timers are set from recipe times. Those times are estimates and may be wrong (sections 7 and 8).

13.4 Voice and text. Voice guidance may be missing, late or different from the text on screen. Neither is guaranteed to be right.

13.5 Screen and battery. Features that keep your screen on use more battery.

13.6 Your control. You can turn notifications off at any time in your device settings.

14. Availability, changes and beta features

14.1 As available. We do not promise that the App will always be available, on time, secure or free of errors. Some features need an internet connection. Your mobile operator may charge you for data.

14.2 Our right to make changes. To the extent the law allows, we may at any time change, add, remove, limit, suspend or discontinue any part of the App, with or without notice. This includes any free or Pro feature, any content, usage limits, prices, and the devices, regions and languages we support. We may move a feature between the free tier and Pro. Reasons for a change include improving the App, changes in technology, in our costs or in our service providers, security, the prevention of abuse, and legal requirements.

14.3 If a change affects what you paid for. If you are a consumer and a change has more than a minor negative effect on your use of Pro during a period you have paid for, your local law may give you the right to end your subscription and to receive a proportionate refund. Nothing in this section limits that right. In all other cases, your remedy is to cancel the renewal of your subscription.

14.4 Beta features. We may offer features that are labeled beta, preview, experimental or similar. They may be less reliable, they may change, and they may be withdrawn at any time. Take extra care with them.

14.5 Ending the App. We may discontinue the App entirely. Where practical, we will try to give reasonable notice. If we discontinue the App during a period you have paid for, you may ask your Store for a refund of the part you did not receive. The Store decides under its own policy. Where the law gives you a right to a proportionate refund, that right applies.

15. Third-party services, stores and devices

15.1 Things we do not control. The App depends on things that we do not control. These include your device and its operating system, your Store, your network, third-party websites and video platforms, sign-in services and our service providers. To the maximum extent permitted by law, we are not responsible for them, for their content, or for any loss they cause.

15.2 Their terms apply. Your use of third-party services is governed by their own terms and policies. You must comply with the third-party terms that apply to you when you use the App, for example your Store’s terms and your mobile data agreement.

15.3 Shopping and prices. The shopping list and any price or savings estimates are planning aids. We do not sell groceries. We are not responsible for shops, prices, availability or products.

16. Disclaimers

Please read this section carefully.

16.1 “As is” and “as available”. To the maximum extent permitted by applicable law, the App and everything available through it are provided “as is” and “as available”, with all faults and without warranties or conditions of any kind, whether express, implied or statutory. This covers recipes, Output, Imported Content, timers, alarms, notifications, voice guidance, drawings, images and all other content. To the maximum extent permitted by applicable law, we disclaim all implied warranties and conditions, including those of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, title, quiet enjoyment and non-infringement, and any that arise from a course of dealing or usage of trade.

16.2 No promises about results. Without limiting section 16.1, we do not warrant that:

  • the App will meet your needs or expectations;
  • the App will be uninterrupted, on time, secure or free of errors or harmful components;
  • any recipe, Output, Imported Content or other content is accurate, complete, safe, reliable or suitable for you or for anyone you cook for;
  • any defect will be corrected; or
  • your data will not be lost.

16.3 Nothing we say creates a warranty. No advice or information that you get from us or through the App, whether spoken or written, creates a warranty that these Terms do not expressly state.

16.4 Your legal rights. Some laws do not allow certain warranties or guarantees to be excluded. If you are a consumer, you may have legal rights relating to digital content and digital services that cannot be excluded, for example rights when a digital service does not conform to the contract. Nothing in these Terms affects those rights.

17. Limitation of liability

Please read this section carefully. It limits what you can recover from us.

If you are a consumer who lives in the European Economic Area, the United Kingdom, Switzerland or Turkey, section 17.6 applies to you in place of sections 17.3, 17.4 and 17.7.

17.1 What these Terms never limit. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Depending on where you live, this may include liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, liability under mandatory product liability law, and your non-waivable statutory rights as a consumer.

17.2 Who is covered. In this section and in section 18, the “Big Spice Parties” means Big Spice and its affiliates, and their officers, directors, employees, contractors, licensors and service providers.

17.3 Loss we are not liable for. Subject to section 17.1, and to the maximum extent permitted by applicable law, the Big Spice Parties are not liable, under any legal theory, for any of the following:

  • (a) indirect, incidental, special, consequential, exemplary or punitive loss or damage;
  • (b) loss of profit, revenue, business, goodwill or expected savings;
  • (c) loss of, or damage to, data or content, including data stored on your device;
  • (d) wasted food, ingredients, time or money, or the cost of a replacement meal, product or service;
  • (e) loss or damage that arises from your cooking, your kitchen, or the food you prepare, serve or eat, including illness, allergic reaction, injury, fire, and damage to property or equipment;
  • (f) loss or damage that arises from relying on any recipe, Output, Imported Content, timer, alarm, notification or voice guidance;
  • (g) loss or damage caused by third-party content, websites, platforms, Stores, devices, networks or service providers;
  • (h) loss or damage caused by the App being unavailable, changed, limited, suspended or ended; or
  • (i) loss or damage caused by events beyond our reasonable control.

This applies whether the claim is based on contract, tort (including negligence), strict liability, statute or any other legal theory, and even if we were told that the loss was possible.

17.4 Cap on our total liability. Subject to section 17.1, and to the maximum extent permitted by applicable law, the total liability of the Big Spice Parties for all claims arising out of or relating to the App or these Terms is limited to the greater of: (a) the total amount you paid for Pro in the 12 months before the event that gave rise to the claim; and (b) fifty US dollars (USD 50).

17.5 Why these limits exist. Most of the App is free, and Pro is offered at a low price. These limits reflect that, and the fact that we cannot see or control what happens in your kitchen. We could not offer the App without them.

17.6 If you are a consumer in Europe or Turkey. The law in some countries does not let us agree the exclusions and limits above with a consumer. So if you are a consumer who lives in the European Economic Area, the United Kingdom, Switzerland or Turkey, sections 17.3, 17.4 and 17.7 do not apply to you. The following applies instead, always subject to section 17.1:

  • (a) We are liable for loss or damage that you suffer as a foreseeable result of our breach of these Terms, or of our failure to use reasonable care and skill. Loss or damage is foreseeable if it was obvious that it would happen, or if, at the time you accepted these Terms, both you and we knew that it might happen.
  • (b) We are not liable for loss or damage that was not foreseeable, that was not caused by our breach or by our failure to use reasonable care and skill, or that was caused by events beyond our reasonable control.
  • (c) We are not liable for loss or damage to the extent that you caused it, or could have avoided it by taking reasonable care. Examples are checking a recipe before you cook, as sections 7 and 8 ask you to do, and installing an update that we offer you free of charge.
  • (d) The App is for personal use. We are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.
  • (e) These Terms describe what the App is and what it is not, in particular in sections 7, 8, 13 and 14. That description counts when deciding what we promised you and whether we used reasonable care and skill.
  • (f) Where another section of these Terms says that we are not responsible or not liable for something, this section 17.6 decides how far that holds for you.

The same applies if you are a consumer who lives in another country whose law does not allow sections 17.3, 17.4 or 17.7 to be agreed with a consumer.

17.7 Time limit for claims. To the extent permitted by applicable law, you must start any claim relating to the App or these Terms within one year after the event that gave rise to it. This does not apply where your local law gives you a longer period that cannot be shortened by contract.

18. Indemnity

18.1 Your indemnity. To the maximum extent permitted by applicable law, you will indemnify the Big Spice Parties and hold them harmless against third-party claims, and against the resulting damages, losses, liabilities, costs and expenses, including reasonable legal fees, that arise out of or relate to:

  • (a) Your Content or your Imported Content, including a claim that importing or using it infringed someone’s rights;
  • (b) your breach of these Terms or of any law;
  • (c) your misuse of the App;
  • (d) food that you prepare for or serve to others, or anything that happens in your kitchen; or
  • (e) your violation of any third party’s rights.

18.2 Handling a claim. We may take over the defense and settlement of any such claim. If we do, you will cooperate with us. You will not settle a claim without our written consent.

18.3 Consumers. If you are a consumer who lives in the European Economic Area, the United Kingdom, Switzerland or Turkey, or in another country whose law does not allow a consumer to give an indemnity of this kind, sections 18.1 and 18.2 do not apply to you. Instead, you are responsible to us, as your local law provides, for loss that you cause us by breaching these Terms or the law. In every case, this section does not apply to the extent that a claim was caused by our own fault where the law makes us responsible for it.

19. Suspension and termination

19.1 You can stop at any time. You can stop using the App at any time by deleting it. If you want to erase your data first, use “Delete my data” in Settings (section 4.6). Neither of these cancels a Pro subscription. You must cancel it separately in your Store account settings (section 5.5).

19.2 Our rights. We may limit, suspend or end your access to all or part of the App, including Pro features, at once and with or without notice, if we reasonably believe that:

  • you have breached these Terms;
  • you are abusing usage limits or trying to get around them;
  • there is fraud, payment abuse or refund abuse;
  • your use creates a risk for us, for other users or for our service providers;
  • you have repeatedly infringed other people’s rights; or
  • the law requires us to do so.

19.3 Ending for other reasons. We may also end your access for any other reason on reasonable notice. If we do that during a period you have paid for, and you have not breached these Terms, you have the remedies that the law and your Store’s policy give you.

19.4 What happens then. When your access ends, your license ends and you must stop using the App. We may delete the records we hold on our servers for your account identifier. Data stored on your device stays there until you erase it or delete the App, but you may no longer be able to open it. Except where the law requires otherwise, you are not entitled to a refund if we end your access because you breached these Terms.

19.5 What survives. Sections 5.6, 5.11, 6.6, 7 to 12, 15 to 18, 20 to 22 and 24, and any other term that by its nature should continue, stay in force after these Terms end.

20. Governing law and disputes

20.1 Talk to us first. If you have a complaint or a dispute, please write to info@ryonlabs.com first and describe the problem. We will try to resolve it with you within 30 days. This step does not take away any right that your local law gives you to go directly to a court, a consumer body or an authority.

20.2 Governing law. These Terms, and any dispute or claim relating to them or to the App, are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

20.3 Courts. Subject to section 20.4, the state or federal courts located in Wyoming, United States have exclusive jurisdiction over any dispute or claim relating to these Terms or the App.

20.4 Consumers keep their local protections. If you are a consumer and the law of the country where you live gives you protections that cannot be set aside by contract, the choice of law in section 20.2 does not take them away. If that law gives you the right to bring a claim in the courts of the country where you live, or requires that claims against you be brought there, that right and that requirement continue to apply. This includes consumers who live in the European Economic Area, the United Kingdom, Switzerland and Turkey. You may also use any consumer dispute body that your local law makes available to you. For example, consumers in Turkey may apply to the consumer arbitration committees and the consumer courts, within the limits set by law.

20.5 Individual claims. To the extent permitted by applicable law, you and we may bring claims against each other only on an individual basis, and not as a claimant or class member in any class, collective or representative proceeding. This does not apply where the law does not allow it to be agreed. This section does not apply to you if you are a consumer who lives in the European Economic Area, the United Kingdom, Switzerland or Turkey. It does not affect the right of a consumer organization or another qualified body to bring a representative action on your behalf where the law provides for one.

20.6 Urgent relief. Either of us may ask any competent court for urgent or interim relief, for example to stop abuse of the App or to protect intellectual property.

21. App store terms

21.1 If you got the App from Apple’s App Store. The following terms apply in addition to the rest of these Terms. If they conflict with another part of these Terms, they take priority.

  • (a) Parties. These Terms are between you and Big Spice only, and not with Apple. Big Spice, not Apple, is solely responsible for the App and its content.
  • (b) Scope of license. The license in section 3 is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
  • (c) Maintenance and support. Big Spice is solely responsible for any maintenance and support of the App, to the extent that these Terms or the law require any. Apple has no obligation to provide any maintenance or support services for the App.
  • (d) Warranty. Big Spice is solely responsible for any product warranties, whether express or implied by law, to the extent that they have not been effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if there was one. To the maximum extent permitted by applicable law, Apple has no other warranty obligation of any kind for the App. As between Apple and Big Spice, any other claims, losses, liabilities, damages, costs or expenses that result from a failure to conform to a warranty are the sole responsibility of Big Spice, subject to these Terms.
  • (e) Product claims. Big Spice, not Apple, is responsible for addressing any claims that you or a third party make relating to the App, or to your possession or use of the App. This includes (i) product liability claims; (ii) any claim that the App fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar laws. These Terms limit the liability of Big Spice to you only as far as applicable law permits.
  • (f) Intellectual property claims. If a third party claims that the App, or your possession and use of the App, infringes its intellectual property rights, Big Spice, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
  • (g) Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo, or that the US Government has designated as a “terrorist supporting” country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.
  • (h) Third-party terms. You must comply with applicable third-party terms of agreement when you use the App.
  • (i) Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
  • (j) Questions and claims. Send any questions, complaints or claims about the App to the contact details in section 25.

21.2 If you got the App from another Store. These Terms are between you and Big Spice only, and not with the operator of the Store. The operator of the Store is not responsible for the App, for its content, for maintenance or support, for any warranty, or for any claim relating to the App. The Store’s own terms apply to your use of the Store and to your purchases. Where the Store’s rules require it, the operator of the Store and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If a mandatory rule of the Store conflicts with these Terms on a matter that the Store controls, the Store’s rule applies to that extent.

22. Export and sanctions

You confirm that you are not located in, and are not a resident of, a country or territory that is subject to comprehensive sanctions or an embargo under the laws that apply to us or to you, including those of the United Nations, the United States, the European Union and the United Kingdom. You confirm that you are not on any list of prohibited or restricted parties under those laws. You must not use, export or re-export the App in breach of export control or sanctions laws.

23. Changes to these Terms

23.1 We may update these Terms. We may do so, for example, to reflect changes in the law, in the App, in our prices or in our service providers, or to improve security or clarity.

23.2 How we tell you. We will post the updated Terms at the same address and change the “Last updated” date. If a change is material, we will give you reasonable advance notice in the App or by another reasonable means.

23.3 Your choice. Where the law allows, your continued use of the App after the updated Terms take effect means that you accept them. If you do not agree, stop using the App and cancel your subscription. Where the law requires your express consent, we will ask for it.

23.4 Not retroactive. Updated Terms do not apply to a dispute that arose before they took effect.

24. General terms

24.1 Severability. Each part of these Terms operates separately. If a court or an authority decides that a part of these Terms is invalid or cannot be enforced, that part will be enforced to the greatest extent the law allows, or changed as little as is needed to make it valid. The rest of these Terms stays in full effect.

24.2 No waiver. If we do not enforce a part of these Terms, or delay in doing so, we do not give up our right to enforce it later.

24.3 Assignment. We may transfer our rights and obligations under these Terms to another organization, for example if we merge or sell the App. This will not reduce your rights under these Terms. You may not transfer your rights or obligations without our written consent.

24.4 Entire agreement. These Terms are the entire agreement between you and us about the App, together with any extra terms that the App shows you for a specific feature or offer, and the purchase terms shown by your Store. They replace any earlier agreement or statement about the App. You acknowledge that, in agreeing to these Terms, you have not relied on any statement, promise or representation about the App that is not set out in them, other than a statement made in the App or in our Store listing about a feature you bought. Nothing in this section limits liability for fraud or fraudulent misrepresentation, or any liability that cannot be limited under the law that protects you as a consumer.

24.5 Language. These Terms are written in English. We may provide translations, including a Turkish translation, for your convenience. If a translation and the English text differ, the English text governs, unless your local law requires the local-language version to prevail for consumers.

24.6 Third parties. Except as stated in sections 17, 18 and 21, no one other than you and us has any right to enforce these Terms.

24.7 Events beyond our control. We are not responsible for a failure or a delay caused by events beyond our reasonable control. Examples include failures of networks, Stores, power or service providers, acts of government, and natural events.

24.8 Reading these Terms. Headings and the summary at the top are for convenience only. “Including” and “for example” mean “including without limitation”.

24.9 Notices and electronic communications. You agree that we may communicate with you electronically. We may give you notices in the App, through your Store, on our website, or by email if you have given us an email address. To the extent the law allows, a notice is treated as received when we post it or send it. You can give us notice at the contact details in section 25.

24.10 No partnership. These Terms do not create a partnership, an agency or an employment relationship between you and us.
